Article 1. Services
These Business Privacy Policy Rules of B-CLUBS GYM d.o.o. (hereinafter: Privacy Policy) regulate the relationship between B-CLUBS GYM as the service provider and persons using the services of B-CLUBS GYM (hereinafter: User).
B-CLUBS GYM provides individual and group training services under the supervision of professional trainers in modernly equipped fitness centers in the territory of the Republic of Croatia, and such services are provided at predetermined times. B-CLUBS GYM d.o.o. operates under the brand “Bfit CLUBS”.
The User acquires the right to use services in the fitness centers of B-CLUBS GYM after registration and purchase of a membership (subscription and/or individual training) on the “Bfit” B2C application or via the website b-fit.hr.
Due to technical or other reasons, the use of services in fitness centers may be temporarily unavailable or limited, for example during renovations and similar situations.
Article 2. Users
The User may be a natural person or a legal entity.
The User is a natural person who purchased B-CLUBS GYM services through the Bfit application or the b-fit.hr website, and a legal entity that has entered into an Agreement with B-CLUBS GYM for the rental of a fitness center.
As a natural person, the User undertakes, at the moment of account creation on the Bfit application, to provide B-CLUBS GYM with their personal data and e-mail address.
In the event that a natural person does not have a valid e-mail address, they are unable to purchase a training package and reserve a time slot through the Bfit application or the b-fit.hr website.
Article 3. Minors
The User may be a minor older than 16 years of age.
Article 4. User Responsibility
Users are obliged and responsible for the accuracy of all data stated in the Bfit application.
B-CLUBS GYM shall not be liable for costs that may arise to Users due to providing false personal data and information when downloading the Bfit application or registering on the b-fit.hr website.
Article 5. User Registration
A User establishing a relationship with B-CLUBS GYM for the first time must provide the necessary registration data via the Bfit application or the b-fit.hr website, such as first name, last name, e-mail address, etc.
Article 6. Change of Data
The User is obliged to notify B-CLUBS GYM in writing of any change in identification data or e-mail address immediately, and no later than within 7 days from the occurrence of such change.
Article 7. Data Processing and Protection
B-CLUBS GYM undertakes to provide protection of customers’ personal data by collecting only the necessary, basic customer/user data required to fulfill our obligations; informing customers about the use of collected data; regularly giving customers the option to choose regarding the use of their data, including the possibility to decide whether or not their name should be removed from lists used for marketing campaigns.
All user data is kept strictly confidential and is available only to employees who require such data to perform their duties. All employees and business partners of B-CLUBS GYM are responsible for respecting privacy protection principles.
Users have the right at any time to:
• Access personal data,
• Correction of personal data,
• Deletion of personal data,
• Restriction of personal data processing,
• Data portability,
• Object to the processing of personal data.
Article 8. Security of Personal Data
We are fully committed to protecting data from unauthorized access, disclosure, or deletion, regardless of the place of storage or processing, as well as the format in which the data is stored. All employees of B-CLUBS GYM undertake to maintain the confidentiality of personal data.
We apply recognized information security standards and: • Implement technical and organizational protection measures based on risk assessment, • Minimize exposure of personal data, • Review methods of information collection, storage, and data processing, • Regularly test organizational and technical protection measures, • Allow access to personal data exclusively to authorized persons, • Take measures to detect possible misuse of personal data, • Take measures to minimize potential damage.
Article 9. Retention Period and Deletion of Personal Data
We store data depending on legal provisions or business needs with the ultimate goal of providing the best service to users.
Different data is stored depending on the purposes for which it was collected.
In addition to other legal regulations, the legal basis for processing and retention periods are prescribed by: • The General Tax Act, according to which we are obliged to keep data for ten years; • The Accounting Act, according to which we are obliged to keep data for eleven years; • The Anti-Money Laundering and Terrorist Financing Act, according to which we are obliged to keep data for ten years; • The Labour Act (employment relationship establishment); • The Right of Access to Information Act (processing your request for access to information).
After the expiration of the statutory retention periods, your data will be deleted.
At any time, the User has the right to submit a request for deletion of personal data. B-CLUBS GYM will delete your personal data, except where the legally prescribed period during which we are obliged to retain your personal data has not yet expired.
B-CLUBS GYM reserves the right to contact you to verify the authenticity of the submitted deletion request, i.e., to verify whether you personally requested the deletion. B-CLUBS GYM may reject the request if it cannot determine your identity as the owner of the personal data.

Article 10. Price
The prices of services and fees of B-CLUBS GYM are determined by the valid price list at the time of user registration on the Bfit application or via the b-fit.hr website.
All prices are retail prices expressed in the official currency of the Republic of Croatia.
The prices valid at the time of registration are published in the Bfit application and on the b-fit.hr website. B-CLUBS GYM is authorized to amend the price list and undertakes to publish and make it available in the usual and accessible manner.
In the event of amendments to the price list, B-CLUBS GYM is obliged to notify Users, in writing or electronically, of the proposed amendments.
Article 11. Payment Method
The User may pay the B-CLUBS GYM fee by card payment through the Bfit application or the b-fit.hr website. Payment is possible with American Express, Diners, MasterCard, Maestro, and Visa credit and debit cards.
B-CLUBS GYM uses Monri WSPay for online payments.
Credit card payment security:
Monri WSPay is a secure online payment system enabling real-time payments by credit and debit cards and other payment methods. Monri WSPay ensures secure entry and transfer of card data for both the customer and the merchant, which is confirmed by the PCI DSS certificate held by Monri WSPay. Monri WSPay uses a 256-bit SSL certificate and the TLS 1.2 cryptographic protocol as the highest levels of protection for data entry and transfer.
Article 12. Types of Membership
B-CLUBS GYM offers Users 4 types of membership:
12-MONTH UNLIMITED SUBSCRIPTION
6-MONTH UNLIMITED SUBSCRIPTION
1-MONTH UNLIMITED SUBSCRIPTION
“VALUE PACK” SUBSCRIPTION FOR 8 TRAININGS IN 1 MONTH
By subscribing, the User acquires a certain number of individual training sessions that can be used to register for group training sessions in the Bfit application or via the b-fit.hr website.
When the User uses all individual training sessions, they may purchase an additional individual training session to register for group training sessions. If the User has an active subscription, the price of an individual training session is lower than if the User does not have a subscription.
All subscription and individual training payments are possible by card payment through the application, as stated in the previous article. The prices of services and fees of B-CLUBS GYM are determined by the price list published in the Bfit application and on the b-fit.hr website.
Article 13. Billing
A User making payment by American Express, Diners, MasterCard, Maestro, or Visa credit and debit cards within the Bfit application or on the b-fit.hr website will be able to view the fiscalized invoice at any time.
The User may file a complaint regarding the issued invoice within 8 (eight) days from the date of receipt of the invoice. If the User does not file a complaint regarding the invoice, it shall be deemed that the User has accepted the invoice in full.
In the event that the User uses a card not owned by them to pay for membership (subscription and/or individual training), the User guarantees that they are authorized to use the said card and assumes full responsibility for all consequences of such use. This includes, but is not limited to, the User’s recourse liability toward B-CLUBS GYM. Therefore, in the event that the card owner disputes the transaction or membership payment (subscription and/or individual training) at any time, withdraws consent, or requests a refund through the bank or card issuer, and B-CLUBS GYM thereby suffers damage, the User is obliged to compensate B-CLUBS GYM for all incurred damages, all bank and card issuer fees, and all related costs. In such cases, B-CLUBS GYM is authorized to immediately block the User’s membership until all due obligations are settled.
B-CLUBS GYM is authorized, with prior written notice to the User, to transfer claims against the User to creditor banks as well as authorized debt collection agencies.
Article 14. Restriction of Use of Services
B-CLUBS GYM has the right to restrict the use of services to the User in the following cases:
a) failure to settle claims of B-CLUBS GYM upon invoice maturity (in the case of legal entities)
b) failure to comply with the Rules of Use of B-CLUBS GYM gyms.
Article 15. Non-Compliance with the Rules of B-CLUBS GYM Gyms
B-CLUBS GYM cares about the safety of its Users.
All Users must behave in accordance with the Privacy Policy and the Rules of Use of B-CLUBS GYM.
In the event of non-compliance with the provisions, B-CLUBS GYM reserves the discretionary right to decide on further measures and actions depending on the severity of the violation.
B-CLUBS GYM reserves the discretionary right to terminate the membership of persons who do not comply with the Terms of Use and Privacy Policy.
B-CLUBS GYM reserves this right in order to guarantee and ensure the personal safety of all members of B-CLUBS GYM gyms at all times and to prevent any unlawful or illegal activities on gym premises.
Possible measures are:
Warning
Suspension of membership (current subscription or current individual training sessions)
Blocking and prohibition of further relationship and purchase of membership
The Rules of Use are available on the premises of B-CLUBS GYM, on the b-fit.hr website, and may also be requested via e-mail at info@b-fit.hr.
Article 16. Video Surveillance
B-CLUBS GYM reserves all rights regarding video recording for security purposes in the premises where training services are conducted (gyms). The primary purpose of video surveillance is the safety of participants in accordance with the GDPR and the Act on the Implementation of the General Data Protection Regulation. The secondary purpose of video surveillance is the protection of property owned by B-CLUBS GYM. For transparency purposes, every gym owned by B-CLUBS GYM clearly indicates at the entrance that the premises are under video surveillance. Recording is limited only to the areas where training services are conducted, and the privacy of users in changing rooms, showers, or toilets is in no way recorded or violated. In accordance with the regulations, video recordings are not stored indefinitely.
Article 17. Method of Submitting Complaints
The User has the right to submit a complaint to B-CLUBS GYM.
All complaints may be sent by post to B-CLUBS GYM d.o.o., Velika Gorica, Fausta Vrančića 14/3, 10410 Velika Gorica, or by e-mail to info@b-fit.hr, or submitted personally at fitness centers.
B-CLUBS GYM will confirm receipt of the complaint in writing without delay and will provide a response within 15 days from the date of receipt of the complaint.
In order for B-CLUBS GYM to respond to a written complaint not submitted electronically, Users are requested to provide accurate information regarding their first and last name and the address to which the response will be delivered. B-CLUBS GYM is legally obliged to provide a written response to the User’s complaint no later than within 15 days from the date of receipt of the complaint.
The rules regarding written complaints do not apply to legal entities, which are subject to the Obligations Act and the Electronic Commerce Act.
Article 18. Dispute Resolution
Consumer disputes may be resolved through the European Commission’s ODR platform https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage
Article 19. Publication of the Privacy Policy
This Privacy Policy shall be published on the b-fit.hr website and in the Bfit application and shall be available in all B-CLUBS GYM fitness centers.
These rules also apply to all Users who registered and/or purchased a membership (subscription or individual training) through the Bfit application or the b-fit.hr website before the entry into force of this Privacy Policy if they are more favorable to the User.
B-CLUBS GYM shall publish and make available all amendments and supplements to this Privacy Policy.
This Privacy Policy enters into force within 8 days from the date of publication in accordance with this Article.
